<br />CITY OF LINO LAKES <br />RESOLUTION NO. 16-96 <br /> <br />RESOLUTION APPROVING SETTLEMENT AND RELEASE AGREEMENT FOR <br />1599 BIRCH STREET <br /> <br />WHEREAS, The City completed road and utility improvements adjacent to Owners’ property <br />(“the Project”). <br /> <br />WHEREAS, After the Project was completed, Owners expressed dissatisfaction with the <br />gradient of the land adjacent to their driveway, which they claim caused water damage to the <br />driveway. The City denies liability for the claimed damages; <br /> <br />WHEREAS, Owners intend to hire a qualified contractor to replace their entire driveway with a <br />new asphalt driveway, and desire to have the City contribute to the cost of the new driveway. <br /> <br />WHEREAS, The City and the Owners have agreed to resolve the outstanding dispute. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes and the <br />Owners have agreed to said Settlement and Release Agreement. <br /> <br />Adopted by the Council of the City of Lino Lakes this 22nd day of August, 2016. <br /> <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />_______________and was duly seconded by Council Member ________________ and upon <br />vote being taken thereon, the following voted in favor thereof: <br /> <br />The following voted against same: <br />_______________________________ <br />Jeff Reinert, Mayor <br />ATTEST: <br /> <br />________________________ <br />Julianne Bartell, City Clerk
