CITY COUNCIL <br />AGENDA ITEM 6A(iii) <br /> <br />STAFF ORIGINATOR: Michael Grochala <br /> <br />MEETING DATE: September 26, 2016 <br /> <br />TOPIC: Consider Resolution No. 16-111, Approving Joint Powers <br />Agreement with the City of Centerville, 21st Avenue Road <br />Extension <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of a Joint Powers Agreement with the City of <br />Centerville for the construction of 21st Avenue South. <br /> <br />BACKGROUND <br /> <br />In July of 2016 the City approved the preliminary plat of Clearwater Creek Business Park. The <br />approval requires the construction of 21st Avenue from Commerce Drive to a point <br />approximately 2,100 feet to the south. The project will include street, storm sewer, water main, <br />and sanitary sewer. The improvements will be constructed by the developer, United Properties. <br /> <br />The proposed improvement is centered on the corporate limits of Lino Lakes and Centerville. <br />Accordingly, and agreement between both cities is required to proceed with the project. Under <br />the terms of the agreement Lino Lakes will provide inspection services for the project. All <br />easements and right-of-way are being provided by the developer. The project is being funded <br />by the developer. Costs for City review time and inspection services are being covered by the <br />cash escrow required under the development agreement. <br /> <br />This is the 3rd agreement covering 21st Avenue south of Main Street. To simply ongoing <br />responsibilities the agreement dissolves the prior agreements. The City of Centerville will <br />continue to maintain street and storm sewer improvements north of Commerce Drive. Lino <br />Lakes will be responsible for 21st Avenue maintenance south of Commerce Drive. Future <br />sealcoating, overlays, or reconstruction will be determined by separate agreement. <br /> <br />The City of Centerville is reviewing the agreement in advance of their council meeting next <br />week. Any proposed changes will be reviewed with the City Council at the meeting. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of Resolution No. 16-111. <br /> <br />ATTACHMENTS <br /> <br />1.
