1 <br /> <br />1st Reading: Publication: <br />2nd Reading: Effective: <br /> <br />CITY OF LINO LAKES <br />ORDINANCE NO. 07-16 <br /> <br />ORDINANCE TO REZONE PROPERTY FROM LIGHT INDUSTRIAL (LI) TO <br />PLANNED UNIT DEVELOPMENT (PUD) FOR LOT 1, BLOCK 1, <br />CLEARWATER CREEK BUSINESS PARK <br /> <br />The City Council of Lino Lakes ordains: <br /> <br />Section 1: Findings of Fact <br /> <br />1. The City received a Land Use Application to rezone certain property from Light <br />Industrial (LI) to Planned Unit Development (PUD) for Lot 1, Block 1, <br />Clearwater Creek Business Park. <br /> <br />2. The Planning and Zoning Board held a public hearing on June 8, 2016 and <br />continued the hearing to July 13, 2016. <br /> <br />3. Per Section 1007.015 (5), the City shall consider possible adverse effects of the <br />proposed rezoning and its judgement shall be based upon, but not limited to, the <br />following factors: <br /> <br />a. The proposed action has been considered in relation to the specific <br />policies and provisions of and has been found to be consistent with the <br />official City Comprehensive Plan. <br /> <br />The proposed development is consistent with the policies and provision of <br />the Comprehensive Plan and AUAR. The PUD approvals include <br />conditions to address the outstanding issues. <br /> <br />b. The proposed use is or will be compatible with present and future land <br />uses of the area. <br /> <br />The proposed distribution center is consistent with the industrial land use <br />classification. <br /> <br />c. The proposed use conforms with all performance standards contained <br />herein. <br /> <br />The proposed 402,552 square foot distribution center is consistent with all <br />performance standards when the recommended conditions of PUD <br />approval have been met. <br />
