layout because it opposes and restricts how the lanes are signed and operated. If adopted, <br />Mn/DOT will have to decide on how to proceed. Their options include: <br /> <br />1. Mn/DOT can change the project to satisfy the City’s conditions. Mn/DOT is not <br />likely to remove the MnPASS designation and restrictions for the new lanes. The <br />project has been proposed and designed based on the use of managed lanes. <br />Additionally, the additional lanes are not located with Lino Lakes. The City does <br />not have authority over how Mn/DOT operates the system. <br /> <br />2. Mn/DOT can proceed to the Appeal Process for Municipal Consent. <br /> <br />3. Mn/DOT can modify the scope & schedule of the project so that Municipal <br />Consent is no longer required by Lino Lakes. This would mean removal of the <br />noise wall and other improvements within Lino Lakes. <br /> <br />At the October 3, 2016 City Council work session staff presented additional options for <br />consideration. <br /> <br />Resolution No. 16-80B was drafted by the City Attorney in response to Mn/DOT comments as <br />an alternative resolution that modifies the recitals to reflect the Council’s general opposition to <br />MnPass Lanes but otherwise approves the layout. Mn/DOT staff is in agreement with this <br />language. <br /> <br />Alternatively, the council may wish to consider a resolution that simply approves the project <br />layout (Attached as Resolution No. 16-80C). <br /> <br />Additional information on the project can be found on the Mn/DOT project website at <br />http://www.dot.state.mn.us/metro/projects/i35wroseville/index.html. <br /> <br />OPTIONS <br /> <br />1. Adopt Resolution 16-80A, Approves layout with condition of no lane restrictions <br />(Mn/Pass) <br />2. Adopt Resolution 16-80B. Opposes Mn/Pass in general but approves layout. <br />3. Adopt Resolution 16-80C. Approves layout <br />4. Take no action.
