Staff contacted the Minnesota Pollution Control Agency (MPCA), which is responsible for <br />administration of the ISTS program, for their opinion. MPCA responded that if a homeowner <br />was completing the installation of a system on their own property anyone hired to assist or help <br />must be a licensed installation business. <br /> <br />This would infer that anyone assisting or helping, without compensation, would not need to be <br />licensed. <br /> <br />Also in question is the involvement of the owner with the actual installation process. Under the <br />law the owner is the individual constructing the ISTS system. The law specifically allows for <br />owners of the property owner to complete the work without being licensed. Staff does not <br />dispute this. However, in the specific case presented above, the owner was not present on site <br />and has not been involved in the construction work. Since the owner, as the permit holder, is <br />ultimately responsible for the work completed on the site, their involvement should be required <br />in some form. Staff would suggest that either the owner or an owner’s designated representative <br />shall be on site during construction. <br /> <br />OPTIONS <br /> <br />1.
