CITY OF LINO LAKES <br />RESOLUTION NO. 16-109 <br />APPROVING PUD FINAL PLAN/FINAL PLAT FOR CLEARWATER CREEK <br />BUSINESS PARK <br />WHEREAS, the City has received an application for PUD Final Plan/Final Plat for Clearwater <br />Creek Business Park hereafter referred to as "Development"; and <br />WHEREAS, City staff has completed a review of the "Development" based on the following: <br />• Application and plans submitted to the City on August 10, 2016. <br />• Revised plans received by the City on September 13, 2016. <br />• Revised plans received by the City on September 14, 2016. <br />• Revised plan received by the City on September 19, 2016. <br />WHEREAS, a public meeting was held before the Planning & Zoning Board on September 14, <br />2016 and the Board recommended approval of the "Development"; and <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby makes the following: <br />FINDINGS OF FACT <br />Per Section 1007.024(1) Purpose and Intent, the PUD, by allowing deviation from the strict <br />provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., <br />by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to <br />encourage: <br />1. A development pattern in harmony with the objectives of the Comprehensive Plan. <br />The industrial development on Lot 1 is consistent with the goals and policies of the <br />comprehensive plan which anticipated development of this property for industrial uses. <br />Clearwater Creek Business Park is consistent with the development standards in the City Code, <br />except that PUD flexibility is requested to allow outside storage adjacent to I -35E. <br />2. Innovations in development that address growing demands for all styles of economic <br />expansion, greater variety in type, design, architectural standards, and siting of <br />structures through the conservation and more efficient use of land in such developments. <br />The development will allow construction of a new 402,552 square foot distribution center on Lot <br />1 and would provide 2 outlots for future development. The development would allow this <br />industrial development while preserving a greenway corridor (as anticipated in the AUAR) via a <br />conservation easement adjacent to Clearwater Creek (Judicial Ditch No. 3). <br />1 <br />
