3. All comments in the MnDOT letter dated September 1, 2016 shall be addressed prior to <br />issuance of a building permit. <br />4. Drainage & Utility easements on Lot 1, Block 1 shall be revised to cover the 100 year <br />flood elevation of Clearwater Creek. <br />5. A Development Contract shall be executed by the City and the developer and recorded by <br />the developer. <br />6. A Roadway, Drainage and Utility Easement, a minimum of 40 feet in width, shall be <br />dedicated for that portion of 21' Avenue within the City of Centerville. <br />7. A Drainage and Utility easement shall be provided to cover the extension of the <br />Clearwater Creek (JD3) culvert within Centerville. <br />8. Temporary Roadway, Drainage and Utility easements, a minimum of 10 feet in width, <br />shall be provided adjacent to the dedicated right-of-way for the east and west sides of the <br />cul de sac. Easement shall remain in place until 21st Avenue is extended and cul de sac <br />removed. <br />9. An access easement agreement to allow the shared access between Lot 1 and Outlot B <br />shall be recorded to the benefit of both properties. <br />10. A conservation easement along Clearwater Creek (JD3) shall be conveyed to the City as <br />proposed. <br />11. A Maintenance Agreement for Stormwater Management Facilities shall be executed by <br />the developer. <br />12. A Joint Powers Agreement between the City of Lino Lakes and City of Centerville shall <br />be approved prior to the construction of 21St Avenue. <br />13. Building material samples must be provided to ensure compliance with architectural <br />standards in the Zoning Ordinance. <br />14. A Letter of Map Revision shall be submitted to and approved by FEMA for the flood <br />plain alterations, adjacent to Clearwater Creek, prior to final release of development <br />securities. <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes: <br />1. That in accordance with the Rezoning to Planned Unit Development exterior storage of <br />semi -trailers shall be allowed in the designate parking locations. <br />2. If a guard house is proposed for construction, the applicant must show that materials have <br />a "harmonious finish treatment" with the principal building. <br />3 <br />
