CITY OF LINO LAKES <br />RESOLUTION NO. 16-111 <br />JOINT POWERS AGREEMENT BETWEEN THE CITY OF LINO LAKES AND <br />THE CITY OF CENTERVILLE REGARDING 21St AVENUE STREET AND <br />UTILITY IMPROVEMENTS AND <br />MAINTENANCE <br />WHEREAS, the corporate boundary between Lino Lakes and Centerville runs north - <br />south through the 21St Avenue right-of-way. The cities have been parties to various joint <br />powers agreements concerning the construction and maintenance of 21St Avenue since <br />1998. The Avenue currently extends from approximately 1,400 feet north of Main Street <br />to approximately 1,400 feet south of Main Street, terminating at the intersection with <br />Commerce Drive; and <br />WHEREAS, the Clearwater Creek Business Park is being platted and constructed along <br />the eastern edge of the 21' Avenue right-of-way in Lino Lakes; and <br />WHEREAS, as part of the Business Park project, the developer, United Properties, will <br />extend 21' Avenue southward from Commerce Drive to a temporary cul-de-sac <br />approximately 2,100 feet south, and construct related storm water and utility <br />improvements as provided in the approved plans (the "Project"); and <br />WHEREAS, the purpose of this Agreement is to set forth the rights and obligations of <br />the cities with respect to the length of 21St Avenue south of Main Street as 21St Avenue <br />will exist upon completion of the Project; and <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br />Lakes that the Joint Powers Agreement with the City of Centerville concerning ongoing <br />rights and obligations concerning 21St Avenue South is hereby approved. <br />Adopted by the Council of the City of Lino Lakes this 26th day of September, 2016. <br />The motion for the adoption of the foregoing resolution was introduced by Council <br />Member Maher and was duly seconded by Council Member <br />Rafferty and upon vote being taken thereon, the following vot-. in favor <br />thereof: <br />Maher, Rafferty, Kusterman, Manthey, <br />The following voted against same: <br />none <br />ATTEST: <br />Bartell, Cit, Clerk <br />Jeff Reinert, <br />
