CITY OF LINO LAKES <br />RESOLUTION NO. 16-132 <br />A RESOLUTION CLARIFYING LICENSING REQUIREMENTS FOR OWNER <br />INSTALLED INDIVIDUAL SEWAGE TREATMENT SYSTEMS <br />WHEREAS, Minnesota Rules, 7083.0700 established licensing requirements for the installation of <br />Individual Subsurface Sewage Treatment Systems (ISTS); and <br />WHEREAS, rules provide that individuals of property may construct an ISTS to serve a <br />dwelling that is owned by the that individual; and any assistance to the owner must be performed <br />by a licensed installation business; and <br />WHEREAS, for purposes of administration of the rules the City Council finds it is necessary to <br />clarify the responsibility of the owner and the circumstances in which the assistance must be <br />performed by a licensed installation business. <br />NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Lino Lakes that: <br />1. Where an owner applies for and receives a permit under the provisions of 7083.0700 the <br />owner or the owner's designated representative shall be on-site during construction of the <br />system. <br />2. Individuals assisting or helping the system owner with installation, without <br />compensation, are not required to be licensed. <br />Adopted by the Council of the City of Lino Lakes this 10th day of October, 2016. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member Manthey and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Rafferty, Manthey, Kusterman, Reinert <br />The following voted against same: <br />Maher <br />ATTEST: <br />Juli.: ne Bartell, C <br />Jeff Reinert, <br />
