CITY OF LINO LAKES <br />RESOLUTION NO. 16-133 <br />APPROVING FINAL PLAT FOR ST. CLAIR ESTATES <br />WHEREAS, the City received an application for Final Plat for St. Clair Estates hereafter <br />referred to as "Development"; and <br />WHEREAS, City staff completed a review of the "Development" based on the following: <br />• Revised civil plans prepared by Plowe Engineering dated February 1, 2017 and received <br />by the City on February 1, 2017 <br />• Revised preliminary plat and final plat prepared by EG Rud & Sons dated February 1, <br />2017 and received by the City on February 1, 2017 <br />• Conservation Easement Exhibit prepared by E.G. Rud & Sons, Inc. dated January 23, <br />2017 <br />• Revised Stormwater Drainage Report prepared by Plowe Engineering, Inc. dated <br />September 7, 2016, and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on June 8, 2016 <br />and continued to July 13, 2016 and the Board recommended approval of the "Development". <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby makes the following: <br />FINDINGS OF FACT <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney approved the status of title/property ownership related to the final plat <br />subject to the conditions listed below. <br />3. A Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or secured by <br />the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid in full. <br />BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby <br />approves the Final Plat for St. Clair Estates subject to the following conditions: <br />1. All comments from City Engineer letter dated February 16, 2017 shall be addressed. <br />2. All comments from Environmental Coordinator letter dated February 15, 2017 shall be <br />addressed. <br />3. A Development Agreement shall be executed by the City and the developer and recorded by <br />the developer. <br />4. Homeowner Association Documents: <br />a. Declaration of Restrictions and Covenants for Enid Island <br />i. The Declaration shall reference and include as an attachment a detailed <br />landscape plan for the Outlot C infiltration basin including plant type, <br />1 <br />
