CITY OF LINO LAKES <br />RESOLUTION NO. 17-23 <br />APPROVING FINAL PLAT FOR ERICKSON ESTATES <br />WHEREAS, the City received an application for Final Plat for Erickson Estates hereafter <br />referred to as "Development"; and <br />WHEREAS, City staff completed a review of the "Development" based on the following: <br />• Revised Preliminary Plat and Civil Plan Set prepared by Loucks dated 02/15/17 <br />• Final Plat prepared by Loucks dated 02/15/17, and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on January 11, <br />2017 and the Board recommended approval of the "Development". <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />hereby makes the following: <br />FINDINGS OF FACT <br />1 The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney approved the status of title/property ownership related to the final plat <br />subject to the conditions listed below. <br />3. A Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or secured by <br />the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid in full. <br />BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby <br />approves the Final Plat for Erickson Estates subject to the following conditions: <br />1. A Development Agreement shall be drafted by the City, executed by the City and the <br />developer and recorded by the developer. <br />2. Easement (Conservation Easement): <br />a. The document shall be in favor of both RCWD and City of Lino Lakes, a political <br />subdivision of the State of Minnesota. <br />b. The legal description shall describe the actual boundary of the easement. <br />3 Declaration (WMC Buffer Declaration): <br />a. The document shall be in favor of both RCWD and City of Lino Lakes, a political <br />subdivision of the State of Minnesota. <br />4. Comments from the City Engineer Letter dated March 2, 2017 shall be addressed. <br />5. Comments from the Environmental Coordinator letter dated March 2, 2017 shall be <br />addressed. <br />6. Sheet 1, Preliminary Plat: <br />a. Please note on the preliminary plat that the angle of the proposed house on Lot 2 <br />limits any future driveway access to the rear yard. <br />
