CITY OF LINO LAKES <br />RESOLUTION NO. 17-34 <br />RESOLUTION APPROVING THE PUD FINAL PLAN/FINAL PLAT <br />FOR NORTHPOINTE 5TH ADDITION <br />WHEREAS, the City received an application for PUD Final Plan/Final Plat approval for <br />NorthPointe 5th Addition hereafter referred to as "Development"; and <br />WHEREAS, City staff completed review of the proposed "Development" based on the <br />NorthPointe 5th Addition Street & Utility Plans dated February 17, 2017 and final plat <br />prepared by Carlson McCain; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on <br />December 11, 2013 and continued to the February 12, 2014 meeting and the Board <br />recommended approval of the PUD Development Stage Plan/Preliminary Plat; and <br />WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned <br />Unit Development with Ordinance No. 02-14 and the PUD Development Stage <br />Plan/Preliminary Plat with Resolution No. 14-21; and <br />WHEREAS, Planning & Zoning Board reviewed and recommended approval of <br />NorthPointe 5th Addition PUD Final Plan/Final Plat on April 12, 2017; and <br />WHEREAS, the proposed development is not considered premature and meets the <br />performance standards of the subdivision and zoning ordinance; and <br />WHEREAS, the PUD Final Plan/Final Plat substantially conforms to the PUD <br />Development Stage Plan/Preliminary Plat. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br />Lakes hereby approves the PUD Final Plan/Final Plat for NorthPointe 5th Addition, <br />subject to the following conditions: <br />1. All comments from City Engineer letter dated April 4, 2017 shall be addressed. <br />2. A Development Agreement shall be drafted by the City, executed by the City and <br />the developer and recorded by the developer. <br />3. The Phasing Plan shall be revised to reflect changes from the original plan. <br />4. Title Commitment: <br />a. Consent of the Mortgagees shall be obtained <br />5. Outlot B, NorthPointe 4th Addition and Outlot C, NorthPointe 5th Addition shall <br />be deeded to the City after all construction, utilities, lift station, restoration and as- <br />builts have been completed and approved by the City Engineer. <br />Adopted by the Council of the City of Lino Lakes this 24th day of April, 2017. <br />
