6. Interest by Officials or Staff of the City <br />No member, officer or employee of the City shall during his tenure or <br />employment and for one year thereafter, have any interest, direct or indirect, <br />in this agreement or the proceeds thereof. <br />7. Covenant Against Contingent Fees <br />The Engineer warrants that he has not employed any person to solicit or <br />secure this agreement for a commission, percentage, brokerage or contingent <br />fee. Breach of this warranty shall give the City the right to terminate this <br />agreement immediately. <br />8. Extra Services <br />No claim will be honored for compensation for Extra Services beyond the <br />scope of this agreement, without written submittal by the Engineer and <br />approval of an amendment to this agreement by the City with the specific <br />estimate of type and time and maximum costs, prior to commencement of the <br />work. The Engineer shall not incur costs in excess of such estimated <br />maximum costs, unless a revised higher amount shall have been approved by <br />the City. <br />9. Records <br />The Engineer shall maintain complete and accurate records of time and <br />expenses involved in the performance of services to be provided by this <br />Agreement, and shall subscribe, if necessary, to a Certified Public <br />Accounting Audit, thereof. <br />10. Covenant Against Vendor Interest <br />The Engineer warrants that he is not employed by a vendor of radio <br />equipment or commercial communications services that could result in a <br />commission, percentage brokerage or contingent fee as a result of Engineer's <br />association with the City. Breach of this warranty shall give the City the <br />right to terminate this agreement immediately. <br />11. Amendment to Agreement <br />This agreement may be amended by further mutual written agreement of the <br />parties thereto. <br />
