AGENDA ITEM'SJ Fk <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE May 9, 1996 <br />TOPIC Thomas Vacha, 7702 Lake Drive, Minor <br />Subdivision. <br />Mr. Thomas Vacha, owner of Thomas Motors at 7702 Lake Dkrive, is <br />requesting a minor subdivision of Lot 4, Block 1, Carole's'Estates. <br />The property is located on 77th Street, just east of Lake Drive and <br />his present dwelling and business. Mr. Vacha has purchased this <br />property and would like to split the west 112 x 121 feet from the <br />balance of the site and add it to his existing dwelling and <br />business. The purpose for this split is to provide a buffer <br />between his business use and the residential neighborhood to the <br />east. <br />The property is Zoned Rural and indicated as single family <br />residential on the Comprehensive Plan. Mr. Vacha's business is <br />considered a pre-existing non -conforming use. For Council <br />information, at one time Lake Drive was zoned commercial from the <br />City's northern boarder south to Circle Pines. No utilities are <br />available to serve these properties, therefore a 10 acre minimum <br />lot size is required. Lot 4, Block 1 is currently 1.03 -acres in <br />size and Mr. Vacha's home/business is .79 acres in size. These <br />properties were created prior to the 10 acre rule. The <br />rearrangement of lot lines would provide 1.10 acres for the <br />home/business and .72 acres for Lot 4, Block 1. <br />According to the submitted site plan, the existing home on Parcel <br />C will meet all the setback requirements.of the Rural Zoning <br />District and provide an alternate site for a septic system should <br />that be required. Parcel B is vacant but is a densely wooded <br />property which could provided an effective buffer between the <br />business use to the west and the residential area to the east. <br />Parcel A is existing and the proposed subdivision will not affect <br />setback requirements. <br />In addition to a minor subdivision request, Mr. Vacha will also <br />need a variance from the Zoning Ordinance, Section 4, Subdivision <br />17, Areas without Sanitary Sewer. This section of the code <br />requires a minimum lot size of 10 acres when sewer and water are <br />not available. Since both lots exist as non -conforming lots, Mr. <br />Vacha is merely asking for a shift in that non -conformity. <br />The Planning & Zoning Board reviewed this item at their April <br />meeting and recommended approval with the following conditions: <br />1. Parcel B shall be legally combined with Parcel A and <br />recorded as such with Anoka County. Parcel B shall not be <br />considered a buildable lot. At some time in the future, when sewer <br />and water become available to 77th Street, Mr. Vacha could then re - <br />subdivide the site and provide an additional building site if so <br />
