Subd 9 <br />Subd 10 <br />Subd 11 <br />Subd 12 <br />Subd 13 <br />Potentially Dangerous Dog. Any dog which meets the definition of <br />potentially dangerous dog set forth in Minnesota Statutes Section 347.50 or <br />any successor statute. <br />Potentially Dangerous Dog. "Potentially Dangerous Dog" means any dog <br />that: <br />(1) when unprovoked, inflicts bites on a human or domestic animal on <br />public or private property; <br />(2) when unprovoked, chases or approaches a person, including a person <br />on a bicycle, upon the streets, sidewalks, or any public or private <br />property, other than the dog owner's property, in an apparent attitude <br />of attack; or <br />(3) has a known propensity, tendency, or disposition to attack <br />unprovoked, causing injury or otherwise threatening the safety of <br />humans or domestic animals. <br />Kennel, commercial. Any parcel of property on which more than two (2) <br />dogs over six (6) months of age are kept, owned, boarded, groomed, <br />sheltered, prod, bred, or offered for sale or any other merchandising <br />that is not defined as a private kennel under Subd 11. Every commercial <br />kennel shall be enclosed or fenced in such manner as to prevent the running <br />at large or escape of animals confined therein. After issuance of a <br />Conditional Use Permit, Commercial Kennels shall be allowed in the <br />following zoning districts: Rural Business Reserve (RBR), Commercial, <br />Industrial. <br />Kennel, private. Any'parcel of property on which more than two (2) dogs <br />over six (6) months of .age are kept for private 'enjoyment and not for <br />monetary gain. Every kennel shall be enclosed or fenced in such a manner as <br />to prevent the running at large or escape of animals confined therein. <br />Private Kennels shall be allowed in all zoning districts upon parcels of <br />property five (5) acres or more in size following issuance of a Conditional <br />Use Permit. <br />Owner. Any person, firm, corporation, organization, or department, <br />possessing, harboring, keeping, having an interest in, or having temporary or <br />permanent custody or control of an animal. <br />Under Restraint. Controlled by a leash of not more than six (6) feet in <br />length; under restraint by an electrical device, i.e. electric fence provided the <br />animal is wearing a shock collar made for that specific electrical device; or <br />within the limits of its owner's premises in any residential district; under the <br />voice or signal command of a competent person whose command the animal <br />will obey immediately in other zoning districts. <br />Page 2 <br />
