AGENDA ITEM 7 B <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE January 20, 1995 <br />TOPIC 95-2-P, K -G Development, 84 White Pine Road, <br />Minor Subdivision <br />BACKER <br />The City Council will recall granting preliminary approval to a <br />plat for the Woods of Baldwin Lake 2nd Addition in October of 1994. <br />Since that time, Mr. Goertz, the developer, has sold an existing <br />home on the property and would like to close on the sale prior to <br />Final Plat. To facilitate this closing, a minor subdivision is <br />necessary to split the existing homesite from the balance of the <br />plat. <br />The property is Zoned R -1X and is located within the MUSA Boundary. <br />The property will be served by utilities in the spring along with <br />the balance of the Woods of Baldwin Lake 2nd Addition. The <br />proposed lot meets all requirements for lot width, depth and square <br />foot area (115 x 135 (avg. depth) and 15,180 square feet in area). <br />For Council information, the existing garage on the site will be <br />removed in the Spring. It is the purchasers intention to construct <br />a new garage in the near future. <br />The Planning & Zoning Board reviewed this request and concurred <br />with Staff in recommending approval of the minor subdivision with <br />the following conditions: <br />1. The newly created lot be made a part of the Final Plat for <br />the Woods of Baldwin Lake 2nd Addition. <br />2. Park Dedication for this lot be included in <br />Plat for the Woods of Baldwin Lake 2nd Addition. <br />3. Utilities be provided, and assessments collected, as a part <br />of the Woods of Baldwin Lake 2nd Addition. <br />The developer has expressed concern regarding condition No. 1. He <br />is anticipating problems with his mortgage company and banker. If <br />this lot is included in the final plat the new owner would be <br />required to sign the final plat document and possibly be a part of <br />the financing arrangements <br />y 30The purpose in proposing condition No. 1 was to provide a "clean <br />\e, legal description" ie. Lot 1, Block 1, rather than a complicated <br />metes and bounds description. <br />1.
