DRAFT 1/5/95 <br />a. Setback requirements from the ordinary high water mark shall not apply <br />to boathouses, piers, and docks. Boathouses may be allowed provided <br />they are not used for habitation and do not contain sanitary facilities. <br />b. In those cases where there are existing adjacent structures which have a <br />setback of less than 50 feet, the setback for new structures shall be equal <br />to the average of the setbacks for the existing adjacent structures. In <br />those cases where there is only one existing adjacent structure which has <br />a setback of less than fifty (50) feet, the setback for the new structure shall <br />be equal to the average of the setback of the existing adjacent structure <br />and the required 50 -foot lakeside setback. <br />c. Accessory structures may be located in the front yard of lakeshore <br />properties upon approval of a riparian lot variance. <br />B. Design Criteria for Structures. <br />1. High Water Elevations. <br />a. Structures must be placed with the lowest floor three feet above the <br />regulatory flood elevation in accordance with the Local Water <br />Management Plan for the City of Lino Lakes. <br />b. Water -oriented structures may have the lowest floor placed lower than <br />the elevation determined in the Local Water Management Plan if the <br />structure is constructed of flood -resistant materials to the elevation, <br />electrical and mechanical equipment is placed above the elevation and, <br />if long duration flooding is anticipated, the structure is built to withstand <br />ice action and wind -driven waves and debris. <br />2. Water -oriented Accessory Structures. Each lot may have one water - <br />oriented accessory structure not meeting the normal structure setback in <br />1102.07, Subd. 2A of this ordinance if this water -oriented structure complies <br />with the following provisions: <br />a. the structure or facility must not exceed ten feet in height, exclusive of <br />safety rails, and cannot occupy an area greater than 250 square feet. <br />Detached decks must not exceed eight feet above grade at any point; <br />b. the setback of the structure or facility from the ordinary high water level <br />must be at least ten (10) feet; <br />c. the structure or facility must be treated to reduce visibility as viewed <br />from public waters and adjacent shorelands by vegetation, topography, <br />increased setbacks or color, assuming summer, leaf -on conditions; <br />Page 17 <br />
