AGENDA ITEM V C <br />STAFF ORIGINATOR Mary Kay Wyland • <br />DATE January 6, 1995 <br />TOPIC 95-3-V, Hardwood Creek, Minor Subdivision and <br />Variance Request <br />Hardwood Creek received approval in November of 1994 to move a <br />house on to the north/east corner of their site at 80th Avenue and <br />Elmcrest. They would now like to sell this dwelling but maintain <br />ownership of the horse arena. Therefore, they are requesting a <br />minor subdivision. <br />The total site is 50+ acres in size and Zoned Rural. T e area <br />containing the dwelling is physically separated from the ba nce of <br />the site, including the horse arena, by Hardwood Creek. Th Creek <br />forms a natural barrier and is proposed as the new lot line. The <br />newly created lot would be approximately 6 acres in size. A <br />minimum of 10 acres is required according to the City Zoning, <br />Ordinance for Rural Districts. The property owner is therefore <br />requesting a variance in addition to the minor subdivision. <br />Staff has reviewed the request and would recommend approval of the <br />minor subdivision and variance for lot area. Hardwood Creek forms <br />an obvious natural barrier and it would seem unreasonable to <br />require the addition of 4 acres on the west side of the creek to <br />this parcel. At this time the area west of the creek is used as <br />pasture land for the horse arena and is not easily accessible to <br />the property on the east side of the creek. Staff further believes <br />any danger in setting a precedent concerning lot area is eliminated <br />by the obvious physical characteristics of this site and the nature <br />of Hardwood Creek. <br />In summary we would recommend approval of the minor subdivision and <br />variance request to allow a 6 acre +/- parcel in a Rural Zoning <br />District with the following condition: <br />1. A Park Dedication fee in the amount of $550 be collected <br />prior to recording of the minor subdivision with Anoka County. <br />
