L <br />Kids at Heart Child Care Center is located at 7330 Lake Drive in <br />the Gethsemane Methodist Church building. They have been at this <br />site since January of 1992 and hold a license from the State of <br />Minnesota for 35 children. Recently a request was submitted to the <br />State to increase the number of children to 42. The breakdown <br />would be as follows: <br />20 Pre School Children 2 1/2 5 years of a <br />15 School Age Children - 5- 12 years of age <br />7 Toddlers 16 months - 2 1/2 yeas <br />The property in question is Zoned R-3, Medium Density Residential <br />and the Zoning Ordinance provides for day care nurseries (15 <br />persons or more) with a Conditional Use Permit. The City was asked <br />to review this center as a result of the request to increase the <br />number of children to 42. In the review process it was determined <br />that a Conditional Use Permit was not obtained in January 1992 when <br />the facility was originally licensed by the State. I believe this <br />was an oversight in 1992 as there were some staffing changes within <br />the City between late 1991 and early 1992 when the original State <br />review occurred. The applicant has, therefore, been required to <br />obtain the necessary Conditional Use Permit at this time. <br />Space has been provided within the church building for a <br />play/fellowship area, nursery, kitchen and restrooms. -A fenced in <br />playground on the site is used for ourdoor recreation. There are <br />currently four (4) full time employees and two (2) part time. The <br />facility is open from 6:00 a.m. to 6:00 p.m. Parking in the church <br />parking lot is more than adequate to serve this use and the church. <br />The State Licensing Division, the Fire Marshall, the Building <br />Inspector and myself have inspected the site and find it to be in <br />compliance with all applicable requirements. The Conditional Use <br />Permit will be subject to various State Inspections and City review <br />on an annual basis. In summary we would recommend approval of the <br />Conditional Use Permit with the following conditions: <br />1. A License from the Minnesota Department of Human <br />be maintained at all time. <br />
