SECTION 4 - GENERAL PROVISIONS <br />Subd. 1. Application of this Ordinance <br />1. Relation to Comprehensive Plan. Comprehensive Plan relates to land use policy. <br />Ordinance should be administered with due consideration of the plan. <br />2. Uses Not Provided for Within Zoning Districts. The Zoning Ordinance should include a <br />provision which specifies how the handling of uses not specifically listed as permitted or <br />denied are to be handled. <br />3. Authority. A reference should be included in the Ordinance of the State Statute granting <br />the City zoning authority (Municipal Planning Act). <br />4. Repeal. As part of the Ordinance update, a statement repealing the existing Ordinance <br />should be included. <br />Subd. 3. Non -Conforming Uses and Structures <br />This section of the existing Zoning Ordinance is relatively complete. There are, however, a <br />number of text additions which should be incorporated as indicated below: <br />1. The section should include a statement of purpose. <br />2. The City may wish to consider the allowance of non -conforming single family dwelling <br />unit expansion via conditional use permit. <br />3. The existing Ordinance specifies that a non -conforming structure damaged less than 75 <br />percent of its market value may be reconstructed in its previous non -conforming state. In <br />comparison to other municipalities, the 75 percent threshold is considered relatively high. <br />This issue should be subject to discussion. <br />4. The Ordinance update should include a provision that states something to the effect that <br />if a non -conforming use is discontinued for a specified time period (i.e., six months), the <br />use may only be re-established in conformance with current Ordinance standards. <br />Subd. 4.
