STAFF ORIGINATOR Mary Kay Wyland DATE August 8, 1994 TOPIC 94-18-C, PUBLIC HEARING, Dorothy Kvitek, 582 Main Street, Conditional Use Permit for Land Reclamation This case involves a request to deposit 6-12" of "topsoil" from the current Main Street reconstruction project on approximately 40 acres of property located at 582 Main Street. The property in question is Zoned R-1 Residentialand according to the City Zoning Ordinance, Sec. 4, Subd. 33 Land Reclamation and Land Gradina, "...Land reclamation shall be permitted by conditional use permit in all districts. Depositing a total of more than fifty (50) cubic yards of material per acre, either by hauling in or regrading the area, shall constitute land reclamation...". Notification has been made in the official newspaper and property owners within 350' of the site have been notified of the request. Our City Engineering Consultant, John Powell, has reviewed the request and has indicated several items that need clarification prior to approval of this permit. They would include the following; 1. A wetland delineation of the site. 2. Correspondence from the RCWD indicating whether or not a permit is required from them. 3. Confirmation as to the quantity of material to be brought in and a detailed grading plat. 4. Topsoil is intended to be stockpiled. Is this surficial topsoil which is to be stripped off and then replaced on the County project or is it a peat, type material which will be mixed with other materials to meet a topsoil specification. Would this mixing be done on the applicant's site? 5. Proper erosion control of site and stockpile as determined by the City Engineer. 5. Seeding and mulching as recommended by the City Engineer immediately following final grading. Approve request with conditions listed above. Table request pending additional information.
