AGENDA ITEM A <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE September 12, 1994 <br />TOPIC 94-21-V, St. <br />Sign Variance <br />ROMM <br />>' <br />Joseph's Church, Elm 1Street, <br />St. Joseph's Church at 171 Elm Street is requesting permission to <br />install a church identification sign which would face I -35W and <br />contain 96 square feet. The property in question is Zoned R-1 <br />Residential. According to Ordinance No. 9-84, Section III, <br />Institutional Identification Signs in R-1 Zoning District; t more <br />than twenty-four (24) square feet; not higher than six (6 feet; <br />one identification -sign allowed per building. The chu ch is, <br />therefore, requesting a variance for 72 square feet in sign area. <br />There are three buildings on the site so number of signs is not an <br />issue. <br />The following Findings of Fact must be when considered when a <br />variance is requested: <br />A. That the property in question cannot be put to a reasonable <br />use if used under conditions allowed by the official controls. <br />B. That the plight of the landowners is due to circumstances <br />unique to his property not created by the land owner. <br />C. That the hardship is not due to economic considerations <br />alone and when a reasonable use for the property exists under <br />the terms of the ordinance. <br />D. That granting the variance requested will not confer on the <br />applicant any special privilege that would be denied by this <br />ordinance to other lands, structures, or buildings in the same <br />district. <br />E. That the proposed actions will not unreasonably diminish or <br />impair established property values within the neighborhood.` <br />F. That the proposed actions will be in keeping with the <br />spirit and intent of the ordinance. <br />City Staff has reviewed the request and would comment that a 24 <br />square foot sign could be installed, meet the requirements of the <br />Ordinance and require no variance. In response to the Findings of <br />Fact: <br />The property can be put to reasonable use as it exists. <br />The landowners plight is not unique <br />A reasonable use for the property does exist without the sign. <br />The City has not allowed other churches larger identification <br />signs. <br />
