COUNCIL MEETING MAY 22, 1995 <br />Council Member Elliott moved to send a letter to Rice Creek <br />Watershed District indicating that the City will find an <br />alternate site acceptable to the Rice Creek Watershed District <br />for mitigation for the Lake Drive (CSAH #23)/Hodgson Road (State <br />Highway #49) improvement. Council Member Neal seconded the <br />motion. Motion carried unanimously. Council Member Bergeson <br />suggested that the site be identified within the next 30 days to <br />allow some time to obtain an agreement with the property owner. <br />Mr. Heth has contacted the MnDOT representative at the State <br />central office regarding when the Cooperative Agreement would be <br />drafted. Mr. Heth was told that the agreement would be completed <br />and delivered to the City on June 2, 1995 for City review. Mr. <br />Heth was told that once the Cooperative Agreement is drafted the <br />money is encumbered. The Cooperative Agreement will be presented <br />to the City Council at the first meeting in June. <br />Mr. Schumacher asked Mr. Heth if the key date to encumber the <br />funds for this project is June 1, 1995. Mr. Heth said no, the <br />date is June 30, 1995, Mr. Heth said Greg Coughlin told him that <br />once the Cooperative Agreement is drafted and clears the Central <br />Office, those monies are encumbered. Mr. Powell recommended that <br />once the Cooperative Agreement is received, a letter be sent to <br />Greg Coughlin stating that the City understands that the funds <br />have been encumbered based on the receipt of the Cooperative <br />Agreement. Mr. Powell said that both the Cooperative Agreement <br />and plans for the improvement and authorization for bids will be <br />presented for Council action at the June 12, 1995 Council <br />meeting. <br />Mr. Schumacher asked Mr. Heth what the status was regarding the <br />intersection signalization agreement. Mr. Heth said that this <br />matter is "stuck" at SEH. He talked to Glenn Van Wormer and was <br />told that this is a standard State Agreement. However, Mr. Van <br />Wormer wants some clarification made between the City's portion <br />of the maintenance and the County's portion of the maintenance. <br />The States portion of the maintenance agreement is standard. Mr. <br />Heth said he would send a memorandum to the City on this matter <br />and Mr. Van Wormer will be in contact with Mr. Powell on this <br />matter. <br />The City Council adjourned to a closed session to discuss the <br />Local 49 Labor Agreement at 8:55 P.M. <br />The City Council returned from the closed session at 9:13 P.M. <br />Council Member Elliott moved to adjourn. Council Member Kuether <br />seconded the motion. Motion carried unanimously. <br />PAGE 29 <br />
