CLOSED COUNCIL MEETING <br />CITY OF LINO LAKES <br />COUNCIL MINUTES <br />JUNE 17, 1992 <br />Staff members present: City Engineer, Darrell Schneider; City <br />Administrator, Randy Schumacher and Clerk -Treasurer Marilyn <br />Anderson. <br />The purpose of the closed meeting was to discuss the Ron Birch, <br />Lake Amelia Estates litigation. <br />Mr. Schumacher reported that the insurance company requested that <br />the City and Mr. Birch meet with the Federal Magistrate to try <br />and mediate some options. Density was one item to be mediated. <br />The result of this meeting is that Mr. Birch was asked to prepare <br />a plan that would meet the zoning requirements. The Magistrate <br />said that it is in the best interest for Mr. Birch to prepare the <br />plan within the next 30 days and then allow the City three (3) <br />weeks to review the plan. <br />Mr. Schumacher explained that the City Attorney has said that if <br />the matter goes to court, the City could be ordered to allow Mr. <br />Birch to plat his property in some manner. This step is an <br />attempt to bring the matter back to the negotiating table and to <br />allow input from Mr. Birch's neighbors. <br />Mr. Schumacher explained that this would be an expensive court <br />case. He proposed that Mr. Art Hawkins be involved in the <br />negotiations so that he would be aware of the entire situation. <br />The closed meeting adjourned at 7:30 P.M. <br />These minutes were considered, corrected and approved at a <br />regular meeting of the Lino Lakes City Council on June 12, 1995. <br />PAGE 1 <br />
