CLOSED COUNCIL MEETING <br />CITY OF LINO LAKES <br />COUNCIL MINUTES <br />APRIL 25, 1994 <br />Staff members present: City Attorney, Bill Hawkins; Consulting <br />Planner, Al Brixius; City Engineer, Darrell Schneider; City <br />Administrator, Randy Schumacher and Clerk -Treasurer Marilyn <br />Anderson. Mr. Tom Radio was also present. <br />The purpose of the closed session was to update the City Council <br />regarding the Amelia Lake Estates litigation and to present a <br />proposed settlement from Ron Birch. <br />Mr. Hawkins explained that Mr. Birch is proposing a settlement in <br />which the City would guarantee that he could subdivide the <br />property into four (4) buildable lots. Mr. Hawkins has asked Mr. <br />Brixius to prepare information regarding whether or not the 45.23 <br />acres would sustain four (4) buildable residential lots which <br />conform to applicable Rural -Executive zoning regulations. <br />Mr. Radio reminded the City Council that this is a privileged <br />City Council session and all information given at this time <br />should not go beyond this meeting. He explained that Mr. Birch <br />has appealed the district court decision on the matter. A brief <br />has been filed in behalf of the City and Mr. Birch will be filing <br />his own brief. The appeal will be heard by a three (3) member <br />panel late this summer or early in the fall. A decision may not <br />be given until after the first of the new year. Mr. Birch's <br />attorney, Fritz Knaack, approached Mr. Radio and suggested that a <br />joint appendix be filed with the courts, however the suggestion <br />was rejected because Mr. Birch wanted to bring certain <br />information into the matter that was not heard by the lower <br />court. <br />Mr. Knaack also has told Mr. Radio that Mr. Birch would be open <br />to settling the case if he could have some assurance that four <br />(4) building sites would be approved by the City Council.
