CLOSED COUNCIL MEETING <br />CITY OF LINO LAKES <br />COUNCIL MINUTES <br />MAY 23, 1994 <br />MBERS PRESENT: Reinert, Neal, Kuether,;Bergeson <br />EBERS ABSENT Elliott <br />Staff members present: City Attorney, Bill Hawkins; City <br />Administrator, Randy Schumacher; Chief of Police, David Pecchia <br />and Clerk -Treasurer Marilyn Anderson. <br />The purpose of the closed Council meeting was for Mr. Hawkins to <br />update the City Council regarding the Reshanau Park Estates <br />Homeowner's Association litigation and the Ron Birch, Lake Amelia <br />Estates litigation. <br />Reshanau Park Estates Homeowner's Association Litigation <br />Mr. Hawkins said that he has received reports that the Reshanau <br />Park Estates Homeowner's Association (RPEHA) has been using the <br />boat launch. Mr. Hawkins telephoned Mr. Hart, the RPEHA <br />attorney, who explained that the RPEHA has decided to use the <br />launch to show that its use would not be a big problem. Mr. <br />Hawkins told Mr. Hart that he would be meeting with the Lino <br />Lakes City Council and that criminal action could be taken <br />against the RPEHA. <br />Mr. Hawkins explained that the next court action in this matter <br />is scheduled for June 8, 1994. The City will ask for summary <br />judgement dealing with the criminal action. Attorneys from the <br />League of Minnesota Cities Insurance Trust will be handling this <br />matter. If the Insurance Trust is not successful, the matter <br />will go to trial. <br />Mr. Hawkins explained that depositions have been taken from City <br />officials and former City Planner, John Miller. The developer of <br />Reshanau Park Estates will be giving his deposition later this <br />week. The case has already cost a great deal of money and could <br />ultimately cost the City from $50,000.00 to $75,000.00. Mr. <br />PAGE 1 <br />
