1 Subdivision 10. [SUBSCRIBER.] "Subscriber" means a consumer or user of a <br />2 communications service delivered through the utilization of Public Property or Public <br />3 Rights -of -Way. <br />4 Section 5. [AUTHORITY FOR USE OF PUBLIC PROPERTY AND PUBLIC RIGHTS - <br />5 OF -WAY TO PROVIDE EMERGING COMMUNICATIONS SERVICES.] <br />6 Subdivision 1. A Person cannot offer Emerging Communications Services unless a <br />7 Permit is obtained from the Local Authority. <br />8 ) Application. This Act applies to every Person using (over. under. on, <br />9 or across) public property or public rights-of-way for the purpose of <br />10 constructing. operating, maintaining. offering or delivering any <br />11 Emerging Communications Services. <br />12 th) A Local Authority acting pursuant to its own authority or in <br />13 conjunction with other political subdivisions shall require a Permit of <br />14 any Person subject to this Act. <br />15 Subdivision 2. <br />16 The PUC shall promulgate uniform statewide standards and regulations <br />17 to ensure that the intent and policy of this Act will be accomplished. <br />18 bi) Within 180 days after the date of enactment of this Act. the PUC shall <br />19 prescribe. and periodically thereafter revise regulations to carry out its <br />20 obligations under paragraph (a) above. <br />381648 - February 9, 1995 - Page 9 <br />Prepared jointly by the law firms of Fredrikson & Byron and Bernick and Lifson <br />
