AGENDA ITEM 10 A <br />o&A6 k{ Pi2si <br />STAPF ORIGINATOR Mary Kay Wyland �V <br />DATE November 9, 1995 <br />TOPIC Clearwater Creek Final Plat (Phase 1) <br />The Preliminary Plat for Clearwater Creek was approved by the City <br />Council in February of 1995 for 157 R-1 Single Family Lots. The <br />property is located south of Cedar Street and east of Otter Lake <br />Road. The City's Comprehensive Plan indicates the property as <br />single family residential. <br />The Developer is requesting Final Plat approval for the first phase <br />of this development. Phase One consists of 83 lots and two outlots <br />which will contain a well/well house and lift station. The <br />preliminary plat had indicated a total of 87 lots for this phase, <br />however, a cul-de-sac was eliminated and some lot lines rearranged <br />to provide the 83 platted lots. At this time the second phase <br />includes 71 lots from the original preliminary plat for a total in <br />both phases of 154 lots plus the two outlots. <br />A Development Agreement was signed on June 6th of 1995 and grading <br />work is nearing completion on Phase 1. Utility construction is <br />underway and financial guarantees are in place. The City Attorney <br />has reviewed the title work for the plat and has indicated that it <br />is acceptable. <br />When the preliminary plat was approved the City Council added two <br />conditions to those outlined by staff. The first condition <br />required disclosure by the developer and/or builders of the <br />adjoining hobby farms in the area. The Developer has included an <br />item in his "Builder's Rules" to inform potential buyers, through <br />the purchase agreement, of area hobby farms. A copy of this <br />document is on file at City Hall and all builders are required to <br />sign the document. The second condition stated that the developer <br />or the RCWD must take responsibility for cleaning the culvert under <br />Elmcrest Avenue. RCWD has assumed that responsibility and the <br />culvert has been cleaned. All other conditions of preliminary plat <br />approval have been met to the satisfaction of City Staff and <br />required landscaping is in place on Otter Lake Drive. <br />We would, therefore, recommend approval of the Final Plat for <br />Clearwater Creek (Phase 1). <br />1.
