AGENDA ITEM 6F <br />ORIGINATOR: Tim Murphy, OSM, Inc. <br />DATE: December 15, 1995 <br />TOPIC: Marshan Lake Condominiums <br />Receive Report and Waiver of Public Hearing <br />BACKGROUND: <br />Pursuant to Minnesota Statute, Chapter 429, and Chapter 8 of the Lino Lakes Charter, <br />Council must receive the report studying the proposed street and utility improvements to <br />the Marshan Lake Condominium project area. <br />As a result of the Utility construction completed as part of the Wenzel Farms and <br />Marshan Shores developments, the sewer and water mains are readily accessible to <br />serve the petitioning property located at the northeast corner of Lake Drive and Aqua <br />Lane. The size, type and depths of the existing utilities are adequate to serve the <br />property. OSM, Inc. has studied the proposed improvements and has determined that <br />the improvements are feasible and should be constructed as shown on the attached <br />figures. <br />The engineer's estimate for the proposed improvements is $874,360. Funding is <br />proposed to be through the collection of assessments levied against the benefitting <br />property. <br />The property owner has signed a waiver of public hearing and appeal of assessment <br />(copy attached). Therefore, no public hearing is required . <br />OPTIONS: <br />1. Return to staff for further review. <br />t90 <br />2. Adopt Resolution 95 -1 Receiving Report and Waiver of Public Hearing for the <br />Marshan Lake Condominium Project <br />RECOMMENDATION: <br />OSM recommends that Council adopt option number 2. <br />
