sk \\LI <br />AGENDA ITEM 4 A <br />/1 <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE May 5, 1995 <br />TOPIC Preliminary Plat - Behm's Century Farms <br />The City Council reviewed this request at their April 24, 1995 <br />meeting. The request involves a 105 lot subdivision, a rezone from <br />Rural to R-1 for a portion of the Lino Air Park Plat that is <br />intended to be included in this subdivision, and a PDO Overlay for <br />the Air Park Lots. At the Council meeting there were several <br />questions raised concerning the subdivision and PDO for the Air <br />Park Lots. Since that meeting Staff has reviewed Council concerns <br />with the Developer and would comment as follows: <br />Concerning the temporary cul-de-sac at the end of the 1st <br />addition,' the Developer has decided to increase the 1st <br />addition by two lots which will allow a temporary cul-de-sac <br />to be constructed at an intersection. This arrangement meets <br />the requirements outlined in the staff report of April 7, 1995 <br />and concurs with the Planning & Zoning Board's recommendation. <br />The Developer has discussed two options pertaining to the <br />"butt" lot detailed in the April 7, 1995 Planning Report. <br />Option 1 would involve the placement of restrictive covenants <br />on the two corner lots which would ensu a their orientation to <br />the north, rather than the east and I thus eliminating the <br />"butt" lot problem - back yards butting up against side yards. <br />Option 2 would eliminate the "butt" lot completely, however, <br />this option is less desirable from the Developers standpoint. <br />The third concern expressed by Council involved the <br />development of protective covenants on the Air Park Lots. <br />Staff has completed a detailed review of the proposed <br />covenants with the developer. The attached memo details those <br />covenants and is recommended to be made a part of the <br />subdivision approval. Prior to Final Plat, Staff will insure <br />that the covenants are recorded with the Air Park Lots and <br />made a permanent part of the development agreement. <br />
