Council Member Elliott <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 95 - 44 <br />RESOLUTION DETERMINING THAT A PETITION TITLED "THE REZONE OF <br />CLEARWATER CREEK BE REFERRED TO THE ELECTORATE FOR APPROVAL OR <br />DISAPPROVAL" IS INSUFFICIENT AND DIRECTING THE CLERK -TREASURER TO <br />DELIVER A COPY OF THE PETITION, TOGETHER WITH A WRITTEN STATEMENT <br />OF ITS DEFECT(S) TO THE SPONSORING COMMITTEE <br />WHEREAS, a petition titled, "The Rezone of Clearwater Creek Be <br />Referred to the Electorate for Approval or Disapproval" <br />was submitted to the City Clerk -Treasurer on March 28, <br />1995, 12:10 P.M., and <br />WHEREAS, the petition is asking that an ordinance titled "The <br />Rezone of Clearwater Creek Be Referred to the Electorate <br />for Approval or Disapproval" be placed on a City ballot <br />so that the citizens of Lino Lakes can vote "aye" or <br />"nay" on the ordinance, and <br />WHEREAS, The Lino Lakes Home Rule Charter states in Section 5.03 <br />Determination of Sufficiency, that the required number of <br />signatures on the petition shall be defined as five <br />percent (5%) of the number of registered voters at the <br />time of the last regular municipal election, and <br />WHEREAS, the number of registered voters in the 1993 Municipal <br />Election was 5,824 which would require that at least 292 <br />signatures of registered voters would be required to make <br />the petition sufficient, and <br />WHEREAS, the number of eligible signatures on this petition is 83, <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City <br />of Lino Lakes hereby determines that the petition is insufficient, <br />and <br />BE IT FURTHER RESOLVED, that the City Clerk -Treasurer is hereby <br />directed to deliver a copy of the petition, together with a written <br />statement of its defects, to the sponsoring committee. <br />Adopted by the Lino Lakes City Council thi 10th day of April, <br />1995. <br />Vernon F.
