LIVING WATERS LUTHERAN CHURCH <br />Conditional Use Permit <br />ten foot drainage and utility easement over the <br />West, East and Southerly 10 feet thereof. <br />3. Conditions. The permit is issued subject to the following <br />conditions: <br />A. All recommendations contained in the November 5, <br />1992 Planning Report prepared by Bob Kirmis/Alan <br />Brixius as follows. <br />B. A deposit in the amount of 1% of the construction <br />costs to be posted, prior to issuance of any <br />building permits, to insure compliance with the <br />permit and completion of all site improvements. <br />C. The landscaping plan be reviewed with the City <br />Forester and modifications mase as recommended <br />including moving some of the evergreen trees from <br />the north side of the parking area to the south side <br />to screen parking from Birch Street. <br />D. Approval of site and drainage plan be received from <br />the Rice Creek Watershed District. <br />E. An easement be provided for the extension of sewer <br />and water utilities through the site. <br />4. Termination of Permit. The City may revoke the permit <br />following a public hearing under any of the <br />following circumstances: Material change of <br />condition of the neighborhood where the use is <br />located, failure to start construction within one <br />(1) year from the date of the permit, violation of <br />the terms of the permit. <br />5.
