DEZELAR. <br />JEAN[NE KUZM[CH <br />Ms. Marilyn Anderson <br />Lino Lakes City Hall <br />1189 Main Street <br />Lino Lakes, MN 55014 <br />Re: Gambling License <br />Dear Marilyn: <br />Suri 101 <br />299COONRAPTDABLvo, <br />COON RAMS, MIN EsoTA 5 3 <br />PRONE (612) 754-2995 <br />The following is my written opinion pursuant to your request concerning the <br />application by the Dead Broke Saddle Club for an approval to conduct a gambling <br />operation in the City of Lino Lakes at the 49 Club. <br />Minnesota Statute § 349.213 specifically authorizes local government units to impose <br />certain regulations upon gambling within the city_ The Lino Lakes ordinance regulating <br />gambling is Chapter 611. Section 611.01 sets forth the specific criteria which an <br />applicant must meet in order to be entitled to receive an approval from the city, <br />Subpart (1) requires that the organization have at least fifteen members that are <br />residents of the city. The ordinance defines member as an individual who must have <br />been a member of the organization for at least six months. it is my understanding that <br />the Dead Broke Saddle Club does not currently have fifteen members who have been <br />members for at least six months and will not meet this requirement until August 1, <br />1995. <br />The question becomes whether the club needs to be in compliance with the <br />membership requirement of the ordinance at the time the approval by the city is <br />requested. Under our ordinance, it is clear that the applicant must meet the <br />requirements of the ordinance at the timt the application is b tted Sect' <br />1- 4.•a...p the C1 plpIfVP:l Li\.PI[ �a submitted. Section <br />611.01 provides, in part, as follows; <br />"Any organization which purports to meet one of the conditions set forth <br />above, shall verify in writing on its application which condition or <br />conditions are being met."'
