BASIS FOR FLEXIBILITY REQUESTS <br />The State Model Ordinance establishes base zoning standards <br />intended to be imposed on a state-wide basis. These regulations <br />give no attention to the unique development constraints of the <br />individual cities within the State. In recognizing that it was <br />impractical to have a single shoreland ordinance applicable to all <br />Minnesota communities, the State allows communities to pursue <br />flexibility from the State Model Ordinance to address conditions <br />unique to the City. <br />As previously discussed, the current Lino Lakes Ordinance adopted <br />in 1983 provides the City a degree of regulatory flexibility to <br />maintain sustainable growth to deal with the development <br />constraints inherent in the City of Lino Lakes. The blanket <br />implementation of stricter ordinances in areas of lot size, <br />density, and impervious surface would serve to reduce the <br />development potential of the remaining buildable land, impacting <br />the City both physically and financially. <br />The following sections outline the physical and regulatory <br />constraints that impact Lino Lakes and serve as a basis for the <br />City shoreland flexibility requests. <br />Buildable Land <br />In January 1995, the City estimated that of the 21,365 acres within <br />the corporate boundaries of Lino Lakes, only 45 percent or 9,695 <br />acres are considered developable due to the regional park, <br />interstate highways, National Wetland Inventory Wetlands and City <br />lakes (see Table A).
