AGENDA ITEM NO. 5 <br />STAFF ORIGINATOR: Marty Asieson <br />DATE: September 22, 1995 <br />TOPIC: Transfer of Property and Hold Harmless for Friends of the <br />Parks <br />BACKGROUND <br />Over the last two years the Friends of the Parks Support Group has <br />received several contributions for parks and recreation. Since the <br />Friends carry no personal liability insurance and are community <br />volunteers, concern was created by the possibilities of exposure <br />from accidents that may occur as a result of these donations. <br />After investigating what other non -profits have done, it was <br />decided that the state laws concerning immunity for public non- <br />profit support groups covered their exposure. In addition the <br />Friends wish to carry this a step further and modeled a Transfer of <br />Property and Hold Harmless agreement similar to the City of Little <br />Canada's non-profit group procedure. This Hold Harmless Agreement <br />has been reviewed by our Attorney Bill Hawkins and found to be <br />satisfactory and proper, with the recommendation that inspection of <br />donations be made prior to accepting such transfers. <br />Please find attached a copy of Bill's letter, and agreements <br />transferring donations to the city. These donations include <br />playground equipment for Wenzel Farms Park, an irrigation system <br />for Sunrise Park, a six foot long park bench for Lamotte Park, and <br />twelve concrete picnic tables for Country Lakes Park, Birch Park <br />and Wenzel Farms Park. <br />Martha Walmsley from the Friends of the Parks will be present to <br />answer any questions for you. <br />OPTIONS <br />1. Accept the procedure for property and services transfer from <br />the Friends of the Parks to the City, and the gifts described in <br />the accompanying agreements. <br />2. Refer back to the Friends of the Parks for further <br />consideration <br />RECOMMENDATION <br />Option 1. <br />
