COUNCIL MINUTES AUGUST 14, 1995 <br />Mayor Reinert suggested that the proposed Conflict of Interest ordinance be adopted as <br />presented and that in the interest of saving staff time and tax dollars, a Notification <br />ordinance be drafted that would require that all property owners within 600 feet of a <br />property requesting a status change be notified by normal mail and the notification will <br />include an affidavit of mailing including the names and addresses of the persons who were <br />mailed the notification. <br />Mr. Landers went out to the hall to confer with other petitioners. <br />Consideration of Letter from Attorney Regarding the Construction of a Townhouse <br />Unit in Wenzel Farms - Mr. Hawkins explained that a townhouse under construction <br />was located only 11 feet from the street right-of-way. The builder did apply for a variance <br />but later sent a letter to the City revoking the variance request and stating that they did <br />have a right to complete the townhouse in the place where it was started. The letter cited <br />other court cases to support the claim. Mr. Hawkins noted that the preliminary plat <br />indicates that the location of all the buildings for this subdivision and indicates that this <br />unit is located the required distance from the right-of-way. The building permit was <br />issued and the building placement error was found when the footing were prepared. Mr. <br />Hawkins said it is his opinion that the error was committed by the builder, Gold Star <br />Builders. All setback requirements have to be met. <br />Mr. Hawkins said based on his review of the matter, the building must be moved to <br />comply with the City Code. Mr. Hawkins will respond to the letter written to the City. <br />NEW BUSINESS <br />Consideration of Minutes, Closed Council Meeting, June 12, 1995 - Council Member <br />Elliott moved to approve the minutes as presented. Council Member Neal seconded the <br />motion. Motion carried with Council Member Kuether abstaining. <br />Consideration of Gambling License for the Dead Broke Saddle Club - Mrs. Anderson <br />explained that the Dead Broke Saddle Club applied for a gambling license earlier this year. <br />However, they did not meet the eligibility requirements at that time and the gambling <br />license was denied. <br />This organization now meets the eligibility requirement; more that 15 members of the <br />Saddle Club live in Lino Lakes and have been members for more than six (6) months. <br />They have already submitted their application to the State and expect to begin their <br />gambling operation at the 49 Club on September 1, 1995 if the City Council approves the <br />gambling license. <br />Council Member Elliott moved to approve the gambling license for the Dead Broke <br />Saddle Club for operation at the 49 Club. Council Member Kuether seconded the motion. <br />Motion carried unanimously. <br />PAGE 24 <br />
