COUNCIL MINUTES AUGUST 14, 1995 <br />Council Member Kuether moved to direct staff to prepare an ordinance titled "Conflict of <br />Interest" as proposed by the citizens petition and present it at the next regular Council <br />meeting for the first reading. Council Member Elliott seconded the motion. Mr. Hawkins <br />explained that this ordinance will amend the City Code. He also noted that there are other <br />State Statutes that deal with conflict of interest in terms of contracts. Mr. Hawkins <br />explained that it is his opinion that there was no necessity for additional regulations. <br />However, the petitioners did feel it was necessary to adopt additional standards. Mayor <br />Reinert felt that this proposal is common sense. <br />Council Member Bergeson expressed concern regarding layering City requirements on top <br />of Charter requirements, statute laws and City Code requirements which already exist. <br />Mr. Hawkins noted that the ordinance would repeal the City Code requirement and <br />substitute the new one in its place. Mr. Hawkins said that it is still his opinion that the <br />existing City ordinance along with the state statutes provisions are sufficient to insure that <br />no City Council member violates any of the provisions without severe sanctions. <br />Mayor Reinert said that there are two(2) choices here. You can listen to the people and <br />enact a new ordinance or you can have the citizens gather signatures on a petition and <br />have the matter placed on the November ballot. Mr. Landers explained that if the <br />proposed ordinance is placed on the ballot and is approved, the only way this ordinance <br />can be removed is by another election. <br />Voting on the motion, motion carried with Council Member Bergeson voting no. <br />Staff will prepare an ordinance and it will be placed on the next regular Council agenda for <br />the first reading. <br />Council Member Bergeson moved to direct staff to prepare an ordinance titled, <br />"Notification Requirements" as agreed expanding the area to be notified from 350 feet to <br />600 feet and to require that an affidavit of mailing be prepared listing the names and <br />addresses of all property owners notified and deleting the certified mail requirement. <br />Council Member Kuether seconded the motion. Motion carried unanimously. <br />Council Member Elliott moved to adjourn at 9:40 P.M. Council Member Neal seconded <br />the motion.
