J. <br />The applicant demonstrate, through the submission of a building elevation(s) <br />that the proposed accessory building complies with R-1 District height <br />requirements (16 feet). <br />k. The proposed accessory building is finished in materials judged by the City <br />Building Inspector to be compatible with the site's principal structure. <br />Comments from other City staff. <br />Approval of a variance to allow an accessory storage building within an R-1 zoning <br />district to exceed 1,100 square feet in size subject to the following conditions: <br />a. The City direct staff to pursue an ordinance amendment which addresses the <br />greater accessory building needs of non-residential uses (i.e., churches, <br />parks, golf courses, schools, etc.) allowed in residential zoning districts. <br />b. Comments of other City staff. <br />ISSUES ANALYSIS <br />Conditional Use Permit Review <br />CUP Evaluation Criteria. As noted previously, the applicants have requested a <br />conditional use permit to allow the expansion of an existing church facility within an R-1 <br />zoning district. <br />In review of conditional use permit requests, Section 5, Subd. 5 (3) of the Zoning <br />Ordinance stipulates that issuance is only permitted if findings are made that such use at <br />the proposed location: <br />1. Will not be detrimental to or endanger the public health, safety, comfort, <br />convenience or general welfare of the neighborhood or the City. <br />2. Will be harmonious with the general and applicable specific plans and policies of <br />the Comprehensive Plan of the City and this Ordinance. <br />3. Will be designed, constructed, operated, and maintained so as to be harmonious <br />and appropriate in appearance with the existing and/or intended character of the <br />general vicinity and will not change the essential character of that area. <br />3 <br />
