P.08 <br />As requested, we have also attempted to provide definitions of the terms "condominium" and <br />"townhome" and explain the differences between these land use terms. <br />Condominium The Lino Lakes Zoning Ordinance defines condominium as: <br />A building, or group of buildings, in which units are owned individually, and the <br />structure, common areas and facilities are owned by all the owners on a <br />proportional, undivided basis. <br />By definition, a condominium has common areas and facilities and there is an association of <br />owners organized for the purpose of maintaining, administering and operating the common areas <br />and facilites. It is a legal form of ownership of real estate and not a specific building style. <br />The purchaser has title to his or her interior space in the building and an undivided interest in parts <br />of the interior, the exterior, and other common elements. The property is identified in a master <br />deed and recorded on a plat with the local jurisdiction. The common elements usually include the <br />land underneath and surrounding the building, certain improvements on the land, and such items <br />as plumbing, wiring, and major utility systems, the interior areas between walls, the public <br />interior spaces, exterior walls, streets and recreational facilities. <br />Towuhome. As you are aware, the request under consideration makes reference to "townhames". <br />The Lino Lakes Zoning Ordinance does not, however, define the term "townhome". A reference <br />document entitled "The Illustrated Book of Development Definitions" (Moskowitz and Lindblom' <br />1981) does, however, provide a commonly accepted definition for the term as follows: <br />A one -family dwelling in a row of at least three such units in which each unit has <br />its own front and rear access to the outside, no unit is looted over another unit, <br />and each unit is separated from any other unit by one or more common fire <br />resistant walls. <br />A townhome unit is a specific type of housing unit. <br />SI1l: ISSUES/ANALYSIS <br />Zoning. The subject property is zoned R-4, High Density Residential. The R-4 District is <br />intended to provide settings for multiple family housing in areas that have good thoroughfare <br />access, have proper relationship to other uses, and are accessible to major activity centers, <br />recreation areas and shopping areas. The proposed multiple family development is consistent with <br />both the intent of the property's R-4 zoning designation and the provisions of the City's <br />Comprehensive Plan. <br />7 <br />
