While <br />the plan may be adegii e, it should be subject to further review and comment by the City <br />Engineer. <br />Parks. In compliance with recommendations of the City Park Board, a 3.0 acre park has been <br />proposed in the northern portion of the subject site. <br />Trash. The applicant has indicated that each individual dwelling unit is to have individual trash <br />removal service similar to that provided to a single family home. <br />Dock. The developer has submitted a dock detail drawing for review. In discussion with the <br />developer, the following use and design conditions will be imposed on the dock development. <br />The developer has issued a letter agreeing to the following items (see Exhibit E): <br />1. The dock will be designed consistent with attached concept plans. Any change m use or <br />design will be subject to City approval. <br />2. The dock design shall be subject to DNR approval. <br />3. The dock design shall be for pedestrian access only. No automobile or boat trailers shall <br />be permitted. <br />4. Lake access from the dock will be canoe access only. <br />5. The dock shall be signed "private property". <br />6. The developer shall outline the lake access restrictions in the townhome deed restrictions <br />and disclose the lake access restriction to all townhome owners. <br />These conditions shall be specifically included in the development agreement required for this <br />project. <br />Handicap Parking Stalls. The revised site plan does not illustrate any handicap parking stalls. <br />According to a representative of the Minnesota State Council on Disability, the American <br />Disability Act does not address handicap parking requirements of owner occupied dwelling units. <br />The proposed owner occupied residential deveJopine t must, however, comply with the handicap <br />parking provisions of the Federal Fair Housing Act. Such act stipulates that one in 25 off-street <br />parking spaces (visitor stalls) mast be devoted to use by the handicapped. <br />Grading, Drainage, and Utilities. The applicant has submitted grading, dniinage, and utility <br />plans that have been reviewed by the City Engineer. The Engineer will provide review comments <br />in a separate Mort.. <br />10 <br />
