Therefore, the granting of the building perms <br />the approved planned unit development lAat encompassed any <br />variances pertaining to that plan. <br />Gold Star Builders have adhered to the pla.rn. a . platted, <br />even if the City of Lino Lakes now wishes to revoke that <br />approval, it can be eqUitablY esto ped from doing so, especially <br />by such an arbitrary and capricious method as the red -tagging ot <br />the building site. Gold Star Builders have relied in good faith <br />upon the act of the City in approving the plat, issuing the <br />building permit and have made a substantial change in their <br />position and have incurred extensive expenses. It would be <br />highly inequitable and unjust for the City to arbitrarily deny <br />their arum;% under their own PECk, upon which Gold Star Builders <br />have already detrimentally relied. <br />
