106,25,96 07:46 LAW OFF I Ltb d1441 41 H Hilt. -> b1d4b44 ib <br />May 16, 1996 <br />Bili Hawkins <br />2140 4th Ave. No. <br />Anoka, MN. 55303 <br />Dear Mr. Hawkins: <br />AGENDA ITEM NO. 8A <br />NU.1bki D02 <br />I am writing you as a member of and on behalf of the Lino Lakes Charter Commission. <br />The Charter Commission is in search of a legal opinion regarding what section is <br />applicable to improvements to existing roads (ie. reconstruction, replacement, upgrades). <br />The Lino Lakes Charter Commission is currently trying to come up with a sound plan <br />to allow for the necessary reconstruction of aging roads in the city. Many cities with <br />charters currently have plans for periodic capital improvements for roads as well as the <br />means to assess for such improvements. Often such funding is shared between those <br />benefitting by the improvements and the city. Part of the benefit would be assessed to <br />abutting households with the remainder coming from a pool of monies designated from <br />the general fund or from a separate capital improvement fund. <br />The question that needs to be addressed is whether the Minnesota 4 <br />to this situation and whether Chapter 6 or 8 of the Lino Lakes Charter wil <br />reconstructive improvements. Is a capital improvement plan for road =construed'o <br />considered as a maintenance item (Chapter 6) or is such an improvement to be designated <br />as new infrastructure (Chapter 8)? <br />Tlw Charter Commission needs to know whether the City of Lino Lakes can utilize the <br />existing Charter format or if the charter must be amended to allow for road improvements <br />on existing streets. <br />Please supply die Charter Commission with something in writing so boat the Charter <br />Commission can discuss and propose ideas to meet the toad improvement needs in our <br />community. We would like to have something prior to the July 1 lth meeting. <br />Thank you for your attention in this matter and I look forward to reviewing your opinion <br />in this matter.
