for the above program. This is the fee for review of the 1995 Comprehensive Annual
Financial Report. The fee is based on total revenues of all funds. This amount is also
based on a nonmember rate (it does not include the cost of a GFOA membership).

Ordinance. No. 08 - 96 was drafted in response to Metropolitan Council's rejection of the
Lino Lakes Individual Sewage Treatment Inspection Code. A draft Ordinance No. 08
96 was prepared and given to Metropolitan Council for their review. Metropolitan
Council has approved the draft noting that it met all of their requirements and concerns.

AN ORDINANCE AMENDING CHAPTER 403, INDIVIDUAL SEWAGE
TREATMENT SYSTEMS
SECTION 403.04, Subd. 2, is hereby deleted and replaced by the following:
SECTION 403.04 Inspection, Subd. 2. Existing System Inspection Procedure:
1. The City will mail an inspection report form by March 1st of each year to
properties containing on-site sewage disposal systems due to be inspected. All
systems will be inspected biennially except for those systems which are up to
code and have less than 50% of the allowable sludge and scum after re -inspection.
These property owners may request a triennial inspection of their systems.
2. Each property owner receiving an inspection report form is to have their septic
tank pumped; the tank inspected; and the report form returned to the City by
September 1 of the same year.
3. The system inspection will include pumping the tank, evaluation of the condition
of the tank and baffles, and an examination of the drainfield area for evidence of
system failure.
4. The inspection of the tank and system is to be made by a qualified person as
determined by the City according to MPCA rules and regulations.
5. Failure by the property owner to complete the form and return it to the City will
be cause for the City to have the system pumped and inspected. The City will
contract to have the work done with all costs to be assessed to the property.

WORKPLACE HARASSMENT POLICY
The City wants to maintain a comfortable and productive work environment that fosters
professionalism. Employees must be free to exercise their duties without fear of verbal or
physical intimidation or duress. The City realizes that the seriousness of harassment and
expresses its earnest desire to prevent the occurrence of such incidents.
POLICY: A fundamental key and policy of the City is to maintain a working environment which
is free of discrimination and harassment of any kind. Both Title 7 of the Federal Civil Rights Act
of 1964 and Chapter 363 of Minnesota State Statutes prohibits discrimination and harassment
(hereafter abbreviated as "harassment") in the workplace. The City does not condone and will
not knowingly tolerate harassment by an employee of any other City employee, job applicant,
official or member of the public with whom employees come into contact while doing work.
Simply put, harassment has no place in the work place.
GENERAL DEFINITION: Workplace harassment may be defined as: comments, or actions
with respect to an employee's religion, race, color, creed, national origin, sex, marital status, age,
sexual orientation or medical or disabling condition which comments or actions causes an
employee to worry or torment or forces the employee being harassed into situations or behavior
not required by the employee's job responsibilities.
Examples of Workplace Harassment: The following are some examples of conduct which may
be considered harassment:
(1) Remarks about a person's body, or sexual activities.
(2) Racial, sexual or ethnic comments.
(3) Patting, pinching or unnecessary touching.
(4) Demanding or suggesting that sexual favors be granted and, if they are not, one's existing
job or promotion potential will suffer.
(5) Physical assault.
(6) Favoritism to one employee over another which has its origins in religion, color, race,
sex, etc.
(7)
Derogatory remarks about a person's age or physical condition.
(8) Relating jokes or dissemination of pictures, cartoons, or stories which are offensive
because they relate to race, sex, age, etc.

(9) The display of pictures, posters, calendars, graffiti or similar materials which are
sexually suggestive, sexually demeaning or pornographic.
REPORTING WORKPLACE HARASSMENT: If an employee believes he or she has been the
victim of harassment or has witnessed an act of harassment they are urged to bring it to the
immediate attention of the City. Employees may do so by filling out the required forms and
meeting with City officials designated to receive this form and trained in dealing with such
reports.
The City's designated officials are the City Administrator and Assistant City Administrator at
Lino Lakes City Hall, 1189 Main Street, Lino Lakes MN 55014, telephone 464-5562. Reports
can be made either verbally or in writing to the designated official at any time during work or off
hours subject to availability. However, harassment investigation cannot commence until the
necessary forms are complete.
If an employee has difficulty filling out the form, the designated official will assist the employee
in doing so.

INVESTIGATION OF HARSSMENT REPORTS: All reports of harassment will be taken
seriously by the City and will be investigated through the conduct of interviews, examination of
relevant records and other inquiries. Although investigations cannot be confidential, they will be
handled with as much discretion as is reasonably possible taking into account the need for a
thorough investigation process.

Upon Completion of the harassment investigation, the City will make a determination as the
whether harassment has occurred and will inform the subject of the alleged harassment and the
alleged harasser of its determination. Where the City has determined that harassment has
occurred, appropriate disciplinary action will need to be taken, up to and including termination of
the harasser.
RETALIATION PROHIBITED: The City will not tolerate any form of retaliation against an
employee who makes a complaint or participates in a harassment investigation. Examples of
prohibited retaliation include discipline, changing work assignments of, providing inaccurate
work information to, or refusing to cooperate or discuss work related matters with any employee
because that employee has reported harassment or cooperated in the investigation of a
harassment report.
If the City determines that an employee has violated the prohibition against retaliation, that
employee will be subject to disciplinary action up to and including termination.

9,200 square foot clinic on Apollo Drive, just south of Lilac. The
property is Zoned General Business and a medical clinic requires a
conditional use permit in the GB Zoning District.

on the site plan and shown as a screened enclosure.

completion of all site improvements. The City's CSO Officer shall
review the building plans prior to issuance of the building permit
to insure compliance with CEPTED recommendations.
2. Landscaping of the site shall be coordinated with the City
Forester.
3. Signage shall conform to the City's Sign Ordinance and
proper permits obtained prior to installation.
4. A park dedication fee shall be required as outlined by City
Ordinance.
5. RCWD Permits shall be obtained, if required, prior to any
site grading.
6. Utility, grading and drainage plans shall be

Outlot A - 3400 square feet (not to be included in plat)
Outlot B - 5.99 acres
All lots meet the minimum requirements for a GB District except
Outlot A, however, this parcel is a remnant lot created when Apollo
Drive was constructed and is currently physically separated from
the balance of the property. This remnant parcel is not being
included in the preliminary plat. Outlot B is being created as an
to provide for future subdivision of the parcel. We would advise
the applicant that the City has a limited access agreement with
Anoka County for Apollo Drive which may restrict access to this
Outlot. At this time access would be via a shared driveway with
the MedCenters parcel.
The Planning and Zoning Board held a Public Hearing at their July
10, 1996 meeting and then recommended approval of both the
preliminary plat and site plan/conditional use permit with the
conditions outlined above.

Plan Review for expansion of Manufactured
Housing Park.
BACKGROUND
Mr. Pau]. Howard, owner of the Baldwin Lake Court Manufactured Home
Park, is requesting approval of a site plan to allow an expansion
of the park. The proposed expansion would involve the addition of
19 homesites with a 16 x 22 optional garage area available for each
unit. The original agreement provided for 21 homesites. The
buildings to be located on the south portion of the parcel will all
be double -wide.
The property was rezoned to R-6, Manufactured Home Park following
a settlement agreement between the City of Lino Lakes and Mr. and
Mrs. Paul Howard in February of 1992. That settlement agreement is
attached for your information. The agreement basically states that
the City will allow an expansion of the park provided certain
conditions are met.
The manufactured home park has been in existence
1950's and currently contains 75 units. The, ,p t
will bring the total to 94 units.
SETBACKS: City Code provides they following se back requ .remen

20' setback between manufactured homes, and 20' sset b between

BUILDING HEIGHT/EXTERIOR: The housing pads are proposed to be 281
x 76' for a possible total of 2,028 square feet in area for the
double wides. Each unit will have space for a 16 x 22 detached
garage.
PARKING/CIRCULATION: Each unit will be provided with two (2) off
street parking spaces, one within the proposed garage. Six (6)
additional spaces have been provided on the plan. A private
roadway will be construction terminating in a cul-de-sac. The
emergency access has been deleted and may allow additional parking
space near the proposed recreational area. The Police and Fire
Departments have reviewed the elimination of this emergency access
and have no objections to its removal. According to the settlement
agreement, a total of four (4) access points to Hodgson Road will
be provided. The current access to the park office will eliminated
to allow this new access.
TRASH HANDLING: The current park has commercial trash handling
service which provides a dumpster for collection. The trash
handling location shall be screened subject to City approval.
LANDSCAPING: A detailed landscaping plan has been submitted which
conforms to the settlement agreement. This plan provides an
evergreen screen between this proposed development and the
residential area to the south and includes 7' and 12' spruce trees.
The final design will be subject to the review and approval of the
City Forester and CSO Officer.
LIGHTING: The CSO Officer has reviewed the lighting proposal with
Mr. Howard and found it to be acceptable.
GRADING/DRAINAGE/UTILITIES: Sewer and water are available to serve
this site. Final plans will be subject to the review and approval
of the City Engineer.
PARK DEDICATION: A park dedication fee shall be required according
to City Policy. Parks Department staff is currently working with
the developer to secure trail easements and a possible canoe launch
site on Baldwin Lake as a part of this development.
In summary, staff would recommend approval of the site plan review
with the following conditions:
1. A development agreement be drafted between the City and the
Howards for all site improvements. Financial guarantees shall be
posted to cover all improvements as determined by the City
Engineer.
2. Proper building permits shall be obtained for all construction
on the site.
3. The Park Board shall determine adequate park dedication in
accordance with City policy.
4. A total of four entrances onto Highway 49 shall serve this
development subject to MnDot Approval. The office access shall be
eliminated.
5. Proper permits shall be obtained from the RCWD.
6. The Howard's shall provide the City with a set of rules and
regulations governing the rental, operation and maintenance of the
park including trash handling and location.
7. All conditions outlined in the Settlement Agreement dated
February 25, 1992 shall be made a part of this permit.
The Planning and Zoning Board reviewed this request at their July
10, 1996 meeting and recommended approval.

WHEREAS, Paul and Ruth Howard, (hereinafter the "HOWARDS"),
commenced the above action, (hereinafter the "LAWSUIT"), against
the City of Lino Lakes, (hereinafter the "CITY"); and
WHEREAS, the Howards are the owners of certain real property
(hereinafter the "SUBJECT PROPERTY") located within the City limits
of Lino Lakes with a legal description as follows:
Lot 12 and 13 of Arthur E. Thom Acres
according to the plat with the Anoka County
Recorder's office.
WHEREAS, the Howards have submitted an application to the City
to rezone the subject property from R-1 to R-6; and
WHEREAS, the Howards have agreed to modify their original
proposal and submit it to the City; and
WHEREAS, the parties to this lawsuit desire to settle the
claims between themselves upon the following terms and conditions;

NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL PROMISES AND
COVENANTS HEREIN, THE PARTIES HERETO AGREE AS FOLLOWS:
1. The Howards will prepare a site plan and rezoning application
to rezone the property from R-1 to R-6 conforming to the
Ordinances of the City of Lino Lakes, including the following
elements:
(a) The Howards will prepare and submit a landscape plan
showing in detail the landscaping as generally depicted
on the plan dated 11/4/91 prepared by
B. B. Chapman, A.I.C.P., St. Paul, Mn.
In addition to the items shown on the general plan, the
plan will include an evergreen buffer on the south
boundary of the property, with every third evergreen tree
in the buffer a minimum of 12' in height, all other trees
will be a minimum of 7' in height.
(b) The manufactured home park will have four entrances to
Highway 49 and a connecting road between the proposed
cul-de-sac and the street immediately to the north as
shown in the plan dated 11/4/91 prepared
by B.B. Chapman, A.I.C.P., St. Paul, Mn.
(c) Howards will allow the placement of only double wide
manufactured homes (with minimum dimensions of 24 x 40
and minimum square footage of 960) on the south side of
the subject property in the area outlined in blue on the
attached Exhibit A with a maximum number of eleven such
homes in said area, provided all setback and other
ordinance requirements are met.
(d) The City will be granted a sewer easement in the private
street, to be constructed as part of the Howard's
proposal.
(e) The Howards shall execute a document in a form prepared
and/or approved by the City Attorney to allow the City to
connect to and use the trail system highlighted on the
attached Exhibit A. The City may access said trail
system in the event the City constructs its own trail
system which could connect to the private trail.
2. Consideration of the modified site plan and rezoning request
will be considered by the Planning Commission and City Council
in accordance with its standard hearing and other procedures.
3. The Park Commission will review and determine the park
dedication fee in accordance with City policy.
4. Any rezoning and site plan approval is subject to the
Metropolitan Waste Control Commission (MWCC) approval for
additional sewer connections necessary to develop the Howard's
proposal as shown. The City will seek necessary approvals
from the MWCC.
5. Any rezoning and site plan approval will be subject to the
Howards obtaining MNDOT, and other necessary approvals, for
the additional highway connection which will be required for
the entrance to the expanded manufactured home park.
6. The Howards will provide the City will a set of rules and
regulations which will govern the rental, operation and
maintenance of the expanded mobile home park. Said rules and
regulations shall be at least as stringent as those presently
in effect for the existing park.
7. During the pendency of the application of the Howards as set
forth in this Agreement, the parties will jointly request that
the Court continue pretrial and trial dates presently set in
this matter.
8. Upon approval of the rezoning and site plan application, as
set forth herein, the parties will execute the attached
Exhibit B, dismissing the lawsuit with prejudice and without
costs, disbursements or attorney's fees to either party.

TOPIC Pheasant Hills East - Final Plat
The Preliminary Plat for Pheasant Hills East was approved by the
City Council in April of 1994. The Plat created four lots, one
containing an existing dwelling, the other three fronting on
Sherman Lake Road. The property was rezoned to R -1X and is
currently located within the MUSA Boundary.
A Development Agreement was signed in August of 1994 and utilities
installed and assessed to the property. Apparently, submittal of
the final plat documents never occurred. This was an oversight of
the developer, Contractor Developer Properties, and was not
realized until one of the properties recently sold.
Final Plat Documents have been received and reviewed by City Staff.
All documentation appears to be in order and we would recommend
approval of the Final Plat for Pheasant Hills East.

This project involves the Installation of trunk sanitary sewer and watermain from the
intersection of Cedar Street and Otter Lake Road (C.R. 84) to Main Street. The
alignment will follow existing Otter Lake Road at the south end, then will tum northeast
and follow the proposed Otter Lake Road corridor.

1996. Three bids were received for the Fluted Column Style Tank which is the same
style as the existing tank near Apollo Drive and Fourth Avenue. The lowest the three
bids was from Pitt -Des Moines,. Inc. in the amount of $992,000 which is un r the
Engineer's Estimate of $1,155,000. Pitt -Des Moines, Inc. also it tailed the existing
tank. A copy of our recommendation of award is attached.

Monday, June 24, 1996, a Union meeting was held and the members present ratified
the following agreement contingent upon majority approval. That evening I received
a call from Steward, Sal Costa, informing me that he had the majority of the
membership in favor of the proposal.
• DURATION. A three (3) year contract effective 1/1/96 through 12/31/98

WAGES. January 1, 1996 - (2%)
July 1, 1996 (2%)
January 1, 1997 - (2.9%)
January 1, 1998 - (2.9%)
The group separately ratified an agreement to participate in the Teamsters
Delta Dental Plan with the understanding that the City agrees to pay $6.00 of
the $33.00 per month toward the insurance coverage.
HEALTH & WELFARE. The City agrees to a cash out payment equivalent to
the premium for single health coverage to those employees that can prove that
they have health coverage under a spouse's plan.
VACATION. The City agrees to a 240 -hour cap in vacation accumulation. The
City also agreed with the Union's clarification that this 240 -hour cap in vacation
applies to all employees and may be carried over from one year into the next
regardless of the years of service.

UNIFORM ALLOWANCE. The City agrees to increase the uniform allowance
to $520 for each year, 1996, 1997 and 1998. To maximize this benefit by
reducing the tax liability, the City is switching to a voucher system. Officers
understand that the details of the program still need to be worked out. They
anticipate that they can go to a uniform store and purchase items on account
and have the billing sent to the City. Officers understand the purchase is still
subject to approval. Additionally, where needed, further clarification may be
found in the Lino Lakes Police and Procedures Manual regarding the purchase
of uniforms and police related equipment. Officers will be allowed to carry over
a maximum of $520 from one year to the next.
If these changes are consistent with your understanding and the Council approves,
either you or I can prepare the contract document. I am uncertain what your past
practice has been, however, we are willing to create the document with highlighted
changes if you wish.

is September 1, 1996. The Saddle Club has applied for renewal of their license and has
provided inforntion so that I can determine whether or not they have met all of the
terms of the Lino Lakes Gambling Ordinance.

MN Statute 349.18 Subd 1 states that thc term of the lease may not begin before the effective date of the premises permit and must expire

By agreeing to the terms of this lease, it is mutually agreed that:
The owner of the property or the lessor
may not manage gambling at the pre-
mises;
The lessor of the premises, his or her
immediate family, and any agents or
employees of the lessee may not partici-
pate as players in the conduct of lawful
gambling on the leased premises;
The lessor and the lessee do not have a
direct or indirect financial interest in the
distribution or manufacture of gambling
equipment
The organization must obtain an organi-
zation icense, gambing manager license
and a premises permit from the Gam-
bling Control Board. The organization
will be responsible for complying with the
laws and rules of lawful gambling;
The term of the lease shall be concur-
rent with the premises permit
The lessor of the premises will allow the
Board or agents of the Board, the Commis-
sioner of Public Safety or agents of the com-
missioner, or the Commissioner of Revenue
or agents of the commissioner, and law en-
forcement personnel to inspect the premises
at any reasonable time, and permit the
organization to conduct lawful gambling at
the premises according to the terms of this
lease. The lessor may not impose any con-
ditions on the organization regarding dis-
tributors of gambling equipment, services,
or the use of profits;
The lease shall be terminated for any illegal
gambling violations occurring on the pre-
mises;
The organization will be responsible for en-
suring that the lessor's business activities
are not conducted on the leased premises;

The lessor of the premises shall provide
the lessee access to the permitted pre-
mises during any time reasonable and
necessary to conduct lawful gambling on
the premises and as agreed upon in this
lease;
The lessor shall not modify, terminate or
refuse to renew this lease in whole or in
part because the organization reported
to a state or local law enforcement au-
thority or the Board the occurrence at the
site of illegal gambling activity in which
the organization did not participate; and
The organization must have, at the gam-
bling premises, a current inventory of
gambling equipment, a sketch with di-
mensions of the premises available for
review, and a clear physical separation
or divider between the lessee's gambling
equipment and the lessor's business
equipment.

This lease is the total and only agreement between the lessor and the organization conducting lawful gambling activities
other than bingo and pull -tab dispensing devices. There is no other agreement and no other consideration required
between the parties as to the lawful gambling and other matters related to this lease. Any changes in this lease must be
submitted to the Gambling Control Board within 10 days of the change.
