agrees and shall require its contractors to agree that every contract for <br />materials, supplies or construction shall contain provisions by which the <br />contractor agrees: <br />(a) That, in hiring of common or skilled labor for the performance <br />of any work under any contract, or any subcontract, no <br />contractor, material supplier, or vendor shall, by reason of race, <br />creed, or color, discriminate against the person or persons who <br />are citizens of the United States or resident aliens who are <br />qualified and available to perform the work to which the <br />employment relates; <br />(b) That no contractor, material supplier, or vendor, shall, in any <br />manner, discriminate against, or intimidate, or prevent the <br />employment of any person or persons identified in clause (1 a) of <br />this section, or on being hired, prevent, or conspire to prevent, <br />the person or persons from the performance of work under any <br />contract on account of race, creed, or color; <br />(c) That a violation of Minn. Stat. 181.59 is a misdemeanor; and <br />(d) That the contract may be cancelled or terminated by Subgrantee <br />or any other person authorized to grant the contracts for <br />employment, and all money due, or to become due thereunder <br />may be forfeited for a second or any subsequent violation of the <br />terms or conditions of the contract. <br />F. General Conditions: <br />1. EFFECTIVE DATE <br />This Subgrant shall be in effect on the date of encumbrance and shall <br />remain in effect until 15 December 1996 , or until all obligations set <br />forth in this Subgrant have been satisfactorily fulfilled, whichever is <br />later. <br />2. TERMINATION <br />This Subgrant Agreement may be terminated in whole or in part (under <br />7 CFR part 3016.44) only as follows: <br />(a) By Grantor with the consent of Subgrantee in which case the <br />parties shall agree upon the termination conditions including the <br />effective date and, in the case of partial termination, the portion <br />to be terminated; or <br />
