AGENDA ITEM 8 A <br />STAFF ORIGINATOR Mary Kay Wyland <br />DATE October 10, 1996 <br />TOPIC PUBLIC HEARING, Resolution No. 96-142, <br />Vacating an existing Ponding and Flowage <br />Easement over Lot 11, Block 1, Lino Air Park <br />North and accepting a revised Ponding and <br />Flowage Easement over Lot 11, Block 1, Lino <br />Air Park North <br />Carl Johnson, owner of Lot 11, Block 1, Lino Air Park, has <br />requested that a portion of the drainage and utility easement over <br />Lot 11, Block 1 be vacated. The easement was originally requested <br />by the Rice Creek Watershed District as a ponding and flowage <br />easement With their Permit No. 94-142, Final Site Drainage Plan for <br />Lino Air Park North. The RCWD has since determined that vacating <br />a portion of this easement would be acceptable. Kurth Surveying <br />has prepared a legal description describing the proposed perpetual <br />ponding and flowage easement. <br />Staff would recommend adoption of Resolution No. 96-142 Vacating a <br />perpetual ponding and flowage easement and accepting a revised <br />easement over Lot 11, Block 1, Lino Air Park North. <br />OPTIONS <br />1. Adopt Resolution No. 96-142 Vacating Perpetual Ponding and <br />Flowage Easement and Accepting Revised Easement over Lot 11, Block <br />1, Lino Air Park North. <br />2.
