AGENDA ITEM 10B <br />STAFF ORIGINATOR: David Ahrens, City Engineer/Public Works Director <br />DATE: October 10, 1996 <br />TOPIC: Resolution No. 96-139, Set Public Hearing for Vacation of a Portion <br />of Fourth Avenue Right -of -Way <br />BACKGROUND: <br />Staff is requesting Council action to vacate the Fourth Avenue right of way from <br />Elm Street to 35W (refer to attached map). The Fourth Avenue right of way has <br />not been utilized since the construction of 35W. With the re -alignment of Elm <br />Street and the construction of Centennial Middle School, this right of way is not <br />needed for public transportation purposes. The property owners adjacent to the <br />right of way will grant Utility Easements to the City for the installation of <br />watermain and sanitary sewer through this corridor. <br />A public hearing is required to release the City's interest in the right of way with <br />notices sent to the affected property owners. The public hearing date is <br />proposed for 6:30 PM on November 11, 1996, at the Lino Lakes Council <br />Chambers. <br />OPTIONS: <br />1. Return to staff for further review <br />2. Not adopt Resoluton No. 96-139. <br />3. Adopt Resolution No. 96-139 setting a public hearing for the vacat of a <br />portion of Fourth Avenue <br />RECOMMENDATION: <br />Staff recommends that option 3 be adopted. <br />
