7 Approval must be obtained from MnDOT for the planting of trees within the 35W <br />right-of-way. <br />8. The drainage and utility plan shall be subject to review and approval of the City <br />Engineer. <br />9. The applicant shall be required to pay a park dedication fee in lieu of land based <br />upon the density of the development. Said dedication amount shall be in <br />conformance with Section 1001.14 of the City Subdivision Ordinance, depending <br />upon the density of the development. <br />10. Snow storage areas may not take up any required parking spaces or block views <br />of motorists entering onto public streets. <br />11. A deed convent shall be established which states that the City shall not be held <br />liable for any damage caused to a vehicle parked within a driveway from snow <br />plowing. <br />12. The applicant must enter into a PDO development agreement with the City. <br />ISSUES ANALYSIS <br />In November, the applicant submitted a development plan that proposed 10 buildings <br />totaling 33 units on the subject site (Exhibit C). In review of the November site plan, City <br />staff was concerned with the tight site design with regard to no provision of a cul-de-sac, <br />lack of sufficient off street parking, minimal setbacks between buildings and no provision <br />of usable open space on the site. City staff recommended the following site plan revisions: <br />1. Reduce the density of the site development by eliminating 4-6 units. <br />2. Provide the required cul-de-sac. <br />3. Provide necessary off-street parking. <br />4. Increase usable open space throughout the site. <br />Upon meeting with City staff in November to discuss the recommended plan revision, the <br />applicant requested the Planning Commission continue its public hearing on this <br />application for one month. The applicant has reevaluated this site plan to address a <br />number of City staff issues and has again submitted a revised site plan. In the following <br />pages of this report we have outlined City staff's current review. Prior to finalizing this <br />report we met with the applicant to discuss further site plan changes and to come to some <br />agreement on an acceptable site design. <br />3 <br />
