AGENDA ITEM 9 A STAFF ORIGINATOR: Mary Kay Wyland DATE: 11/21/96 TOPIC: 96-33 Amended Conditional Use Permit 6221 Minnesota BACKGROUND: Teleport Minnesota is requesting an Amended Conditional Use Permit to allow the construction of a 10 x 20 equipment shelter and the placement of a 9.3 n C -Band Satellite Antenna on their site at 6221 Holly Drive. The P & Z will r� reviewing a similar request in 1995 for a small equipment building and two satellite antenna's. In fact, overall, the City has reviewed seven (7) conditional use permits for this site since 1984. According to the Zoning Ordinance, transmission towers and other similar towers up to 55' in height are permitted uses . Towers between 55' and 200' are permitted with a conditional use permit. Additionally, any time there is a change or alteration to an existing conditional use permit, an amendment is required. The property in question is Zoned Rural and indicated as such on the City's Land Use Map. The parcel of property contains approximately 120 acres and is owned by VVCCO Inc. Teleport Minnesota has a lease agreement with 1NCCO. The Planning & Zoning Board recommended approval of this request at a Public Hearing on Wednesday, November 13th with the following conditions: 1. Proper building permits shall be obtain prior to construction. 2. Criteria outlined in Resolution No. 10-91 shall be made a part of this permit. (Resolution 10-91 was adopted by the City in response to a previous Amended Conditional Use Permit for this property - copy attached) including enhancement of the landscaping plan to further screen the facility from adjoining properties. This Plan shall be subject to review and approval by the City Forester. OPTIONS; 1. Approve Amended Conditional Use ,Permit as requested with conditions outlined above. 2. Return staff for further consideration
