AGENDA ITEM 3 <br />STAFF ORIGINATOR: David Ahrens, City Engineer/Public Works Director <br />DATE: November 6, 1996 <br />TOPIC: Public Hearing for Vacation of a Portion of Fourth Avenue Right of <br />Way <br />BACKGROUND: <br />The consideration of vacation of any public easement or right of way must <br />include a public hearing per City Ordinance. The public hearing scheduled for <br />the November 12, 1996, Council Meeting, is to solicit input for the vacation of the <br />Fourth Avenue right of way from Elm Street to 35W. The attached map <br />illustrates this segment. <br />Fourth Avenue right of way has not been utilized for transportation purposes <br />since the construction of 35W. With the re -alignment of Elm Street and the <br />construction of Centennial Middle School, the right of way is being used as the <br />main driveway entrance to the middle school and for City utilities. Access to the <br />light industrial property to the north is planned to be from Lake Drive. For these <br />reasons the use of this right of way for public transportation purposes is no <br />longer needed. <br />RECOMMENDATION: <br />No action is requested at this time as utility easements are needed from the <br />adjacent property owners prior to vacation of the right of way. The documents <br />for these easements are near completion and the property owners have signed <br />agreements to grant the City the easements. However, staff feels more <br />comfortable that the vacation of the right of way and acceptance of the utility <br />easements by the City be done at the same time. <br />
