Language is often used interchangeably, but may be applied <br />differently depending on the relevant jurisdiction involved. <br />Despite the use of these various terms for generally similar practices, there <br />are fundamental differences in actual operations that affect a local <br />government’s ability to regulate a particular type of activity. <br />A.Peddlers <br />City of St. Paul v. Briggs, 85 <br />Minn. 290, 88 N.W. 984 <br />(1902). <br />A peddler is generally described as someone who: <br />•Travels about from place to place with no fixed place of business. <br />•Carries the actual merchandise offered for sale, not merely samples of <br />such products. <br />•Sells the merchandise at the time it is offered for sale. <br />•Delivers the merchandise at the time the sale is consummated. <br />•Sells to the ultimate consumer and not to a retail establishment for an <br />expected resale of the merchandise. <br />Also commonly known as hawkers, peddlers carry the actual products <br />offered for sale from place to place. <br />See Part V-Local regulations. Cities generally have the authority to either license or register peddlers who <br />wish to operate within the city’s jurisdiction. <br />See Part IV-section C <br />Commerce Clause. <br />See Part II-section B <br />Solicitors and canvassers. <br />The licensing or regulation of peddlers usually does not raise constitutional <br />concerns under the Commerce Clause because both product delivery and <br />payment occur during the initial interaction. With peddling, goods are not <br />typically shipped into the local jurisdiction for delivery at a later date and <br />time.
